Online store terms and conditions

§ 1. Preliminary Provisions

The online store BALASTMANIA, available at www.balastmania.com, is operated by Krzysztof Harbul, conducting business under the name Balastmania Krzysztof Harbul, registered in the Central Registration and Information on Business (CEIDG) maintained by the minister responsible for the economy, NIP: 583-349-92-04, REGON: 527501620.

These Terms and Conditions apply to both Consumers and Entrepreneurs using the Store and set the rules for using the online store as well as the terms and procedure for concluding Distance Sales Agreements with Customers via the Store.

§ 2. Definitions

Consumer – a natural person concluding a contract with the Seller within the Store whose subject is not directly related to their business or professional activity.

Seller – natural person conducting business activity under the name Balastmania Krzysztof Harbul, registered in CEIDG, NIP: 583-349-92-04, REGON: 527501620.

Customer – any entity making purchases through the Store.

Entrepreneur – a natural person, legal person, or organizational unit without legal personality, with legal capacity, conducting business activity in their own name.

Store – the online store operated by the Seller at www.balastmania.com.

Distance Agreement – a contract concluded with the Customer within a structured system for concluding distance contracts, without simultaneous physical presence of the parties, using remote communication means.

Terms and Conditions – these Terms and Conditions of the Store.

Order – the Customer’s declaration of intent made via the Order Form to conclude a Sales Agreement.

Account – the Customer’s account in the Store containing data provided by the Customer and order information.

Registration Form – a form enabling account creation.

Order Form – a form enabling placing an Order, selecting Products, delivery, and payment methods.

Cart – a software element in the Store showing selected Products.

Product – a movable item or service available in the Store that is the subject of the Sales Agreement.

Sales Agreement – a contract for the sale of a Product between the Customer and the Seller, including service or work contracts where applicable.

§ 4. Technical Requirements

To use the Store, browse the assortment, and place orders, the following are required:

A device with Internet access and a web browser (computer, laptop, tablet, phone),

Active email account,

Enabled cookies,

Installed FlashPlayer program.

§ 5. General Information

The Seller is not responsible for Store disruptions caused by force majeure, unauthorized third-party actions, or incompatibility with the Customer’s technical infrastructure.

Browsing the Store does not require an Account. Orders can be placed with or without an Account by providing personal and address data.

Prices are shown in Polish zlotys or euros and include VAT.

The total payable amount includes the Product price and delivery costs.

For ongoing services, the final price covers all payments for the billing period.

If the price cannot be calculated before contract conclusion, the Store provides the method of calculation and delivery costs.

§ 6. Account Registration

To create an Account, complete the Registration Form with name, email, phone, billing address, delivery address, and, for companies, company name and VAT number.

Creating an Account is free.

Login uses the credentials provided during registration.

The Customer may delete their Account at any time by sending a request to the Seller (email or letter).

§ 7. Placing Orders

To place an Order:

Optionally log in to the Store,

Select Products and add to Cart,

Log in or place an Order without registration,

Complete the Order Form (recipient data, delivery address, delivery method, billing data if different),

Click “Order and Pay” and confirm via email link if required,

Choose payment method and pay within the deadline (§ 8 point 3).

§ 8. Delivery and Payment Methods

Delivery methods:

Courier shipment (standard or cash on delivery),

Parcel locker,

Personal pickup (ul. Bp. Dominika 25B, 81-001 Gdynia).

Payment methods:

Personal pickup payment,

Cash on delivery,

Bank transfer to Seller’s account,

Electronic payments.

§ 9. Execution of the Sales Agreement

The Agreement is concluded upon Order placement per §7.

The Seller confirms receipt of the Order via email and proceeds with fulfillment.

Payment deadlines:

Bank transfer/electronic payments: 3 days from contract conclusion,

Cash on delivery: upon receipt,

Cash on personal pickup: within 3 days of notification of readiness.

Delivery times are specified per Product; for multiple products, the longest applies unless partial shipment is requested.

Delivery term starts from:

Bank transfer/electronic payment: date of receipt of payment,

Cash on delivery: date of contract conclusion.

Personal pickup is free of charge.

Delivery available within the EU.

Delivery costs are shown in the Store and during ordering.

§ 10. Right of Withdrawal

Consumers may withdraw from the Agreement within 14 days without giving reasons.

The withdrawal period starts from receiving the last Product.

Withdrawal statements can be sent by post or email.

Upon withdrawal:

The contract is considered void,

The Seller refunds all payments within 14 days (excluding additional delivery costs chosen by the Customer),

Refunds use the same payment method unless agreed otherwise,

Refund may be withheld until the Product is returned,

The Product must be returned at the Customer’s cost within 14 days,

The Customer is responsible for any diminished Product value.

Withdrawal rights do not apply to:

Custom-made items,

Sealed goods opened for hygiene reasons,

Perishable goods,

Digital content delivered with prior consent before withdrawal period ends.

§ 11. Complaints and Warranty

The Agreement concerns new Products free from defects.

Complaints can be made under statutory warranty (rękojmia).

Complaints should be submitted in writing or by email, including defect description, circumstances, date, Customer data, and claim.

The Seller responds within 14 days.

Returned goods under complaints should be sent to the address in §3.

Warranty terms (if applicable) are described with the Product or warranty card.

§ 12. Out-of-Court Dispute Resolution

Information about out-of-court dispute resolution is available at consumer advocates, Trade Inspection, and UOKiK websites:

Permanent consumer arbitration court (art. 37 Trade Inspection Act),

Free assistance from consumer advocates or organizations.

§ 13. Personal Data in the Store

The Seller is the data controller.

Data is collected to fulfill the Sales Agreement or for marketing (with consent).

Data recipients include delivery carriers and payment processors.

Customers have the right to access and correct data.

Providing data is voluntary but necessary to conclude the Agreement.

§ 14. Final Provisions

Agreements are concluded in Polish.

The Seller may change the Terms and Conditions for important reasons (law changes, payment/delivery methods), informing Customers at least 7 days in advance.

Unregulated matters are governed by Polish law (Civil Code, Electronic Services Act, Consumer Rights Act, Personal Data Protection Act).
